Making a motorcycle accident claim

You have three years from the date of your accident, or the date you discovered your injuries were a result of your accident to make a cycling accident claim. For those under the age of 18, you have three years from the date of your 18th birthday to make a claim. When can I claim for cycling accident compensation?

There are many causes of motorbike accidents. The most common causes in cases we deal with include:

If you have been injured in a motorbike accident that wasn’t your fault, you are entitled to claim for compensation. Even if you are partly responsible for your accident or injury you may still be able to claim. For example, if you were hit by a reckless driver whilst not wearing a helmet you are entitled to claim compensation as the driver is responsible. However, you may receive less compensation because you were not wearing a helmet.

You can also claim if you were injured in an accident caused by a pothole or a poor road surface. If this is the case, you can make a claim against your local authority.

Even if you have been injured in a hit and run accident or by an uninsured driver, you can still make a claim. If we cannot find out who caused your accident, HNK Solicitors can help you claim through the Motor Insurer’s Bureau (MIB).

Who are the Motor Insurers Bureau and what do they do?

The Motor Insurers Bureau (“MIB”) is a private governed body set up to compensate victims involved in road traffic collisions with an uninsured and/or untraced driver.

They are often a way for accident victims to be compensated for injuries where the at fault driver has fled the scene.

The MIB shall conduct a variety of investigations to ensure that they are satisfied that an incident has occurred as described before making a decision as to whether they shall compensate the victim. This can include a witness statement from the victims involved, obtaining the Police report, liaising with the victim’s insurance company and obtaining medical records/evidence.

Unfortunately, the MIB is not bound by timescales, however, as a rule of thumb, they tend to work on matters a minimum of every 28 days.

How much compensation can I claim?

The amount of compensation you can claim for a motorcycle accident depends on the extent of your injuries, the damage to your property, and the financial, emotional and physical impact it has had on your family. • A repair estimate or invoice from an independent motorcycle repair shop
• The approximate age of the motorbike
• Photographs of the damage to the motorbike and a wide angle shot of the whole motorbike showing the make and model
