British Airways Data Breach

British Airways Data Breach

British Airways have announced that they have been subject to several data breaches, where hundreds of thousands of customer’s personal information and financial details were compromised. If you have been subject to one of these data breaches, you could be entitled to claim compensation of up to £6,000.

The airline announced on the 6th September 2018 that their security systems had been breached by hackers and 500,000 customers had had their personal data and card payment details were stolen. Whilst investigating this breach a second data breach was spotted affecting a further 185,000 people. In 2019 a third British Airways Data Breach was uncovered through their e-ticketing system, where hackers could access and change the flight booking details and personal information of passengers. The impact of these breaches was huge.

The Information Commissioners Office (ICO) has issued a notice of intention to fine British Airways £183 million over the breach under the new GDPR. After a High Court hearing, the final cut-off date to join group litigation to claim compensation from British Airways was established as the 17th January 2021. Therefore, it is important you act now to ensure you get the compensation you deserve before time runs out.

Financial losses from the breach can be claimed as well as compensation for the distress caused to the victims. In those cases where the psychological injury is extreme, compensation could be as high as £16,000.

Act now

The cut-off date to join a group litigation claim against British Airways is the 17th January 2021. Therefore, it is important you act now before it is too late

HNK offers a no-win-no-fee service which means it will cost you nothing upfront to start your claim. This means you can pursue a case on a no-risk basis, and you’ll only have to pay a small percentage if your claim is successful and you are awarded compensation.

Your claim

HNK Solicitors will fight to get you the compensation you deserve. You do not need to have suffered any financial loss or emotional distress to make a claim, a privacy violation alone is enough to make a claim.

Have British Airways admitted liability?

British Airways have offered to reimburse customers who have suffered financial loss as a result of the breach but have so far failed to admit liability for this breach.

What is a group litigation case?

A group litigation claim or case is where a group of people – which can be as many as thousands – have all been affected by the same issue. All the people in the group collectively bring their cases to court against the Defendant and fight together to get compensation. This strengthens their overall position and can make a big organization take a matter more seriously. It can also increase their chances of settlement or success in litigation.

Just because you are part of a group litigation claim this doesn’t mean that everyone in the group will receive the same amount of compensation. Every claim within the group is settled based on the individual’s situation.

What can I claim for?

If your data has been breached you can claim for both damages and distress. So, therefore you can claim for any financial losses or emotional distress you have suffered as a result of having your data stolen. However, you can also claim for the failure to protect your data, even if you haven’t suffered as a result, as by law, they have a duty to keep your personal data safe.

What should I do if I think I’ve been affected?

If you think you have been affected by the BA data breach, you should seek legal advice to see if you are entitled to make a claim. Contact HNK Solicitors today for a free no-obligation consultation and we will be able to tell you if you have a case or not. If you do, we can then pursue this claim for you and get you the compensation you deserve.

How much will I pay if I win?

If we win your case for you, the legal costs which consist of the work HNK Solicitors has done for you and disbursement costs such as court and barrister fees will be recovered from British Airways themselves and the compensation you are rewarded. HNK cap the costs they take from your compensation at 35%, unlike other lawyers who often take up to 40%, meaning with HNK you get to keep more of your money.

When you sign the agreement there may be some large figures such as high hourly rates for our solicitor’s work but don’t be intimidated, remember you are only charged if you win and if we can we will try and recover all of your disbursements and legal costs from British Airways. We will provide a full breakdown of costs if you succeed, so you understand exactly what you have been charged for.

You will get at least 65% of your compensation in the end, no matter what, e.g. if you are awarded £1000, you’ll get to keep at least £750 minimum. Whereas with many other Solicitors you only get to keep 55%.
