For those under the age of 18, you have three years from the date of your 18th birthday to make a claim. When can I claim for cycling accident compensation?

There are many causes of cycling accidents. The most common causes in cases we deal with include:

If you have been injured in a cycling accident that wasn’t your fault, you are entitled to claim for compensation. Even if you are partly responsible for your accident or injury you may still be able to claim as in most cycling accident claims it is unusual for a motorist to not be at least partly to blame when they collide with cyclists. For example, if you were hit by a reckless driver whilst not wearing a helmet you are entitled to claim compensation as the driver is responsible. However, you may receive less compensation because you were not wearing a helmet.
You can also claim if you were injured in an accident caused by a pothole or a poor road surface. If this is the case you can make a claim against your local authority.
Even if you have been injured in a hit and run accident or by an uninsured driver, you can still make a claim. If we cannot find out who caused your accident, HNK Solicitors can help you claim through the Motor Insurer’s Bureau (MIB).

Who are the Motor Insurers Bureau and what do they do?

The Motor Insurers Bureau (“MIB”) is a private governed body set up to compensate victims involved in road traffic collisions with an uninsured and/or untraced driver.
The MIB shall conduct a variety of investigations to ensure that they are satisfied that an incident has occurred as described before making a decision as to whether they shall compensate the victim. This can include a witness statement from the victims involved, obtaining the Police report, liaising with the victim’s insurance company and obtaining medical records/evidence.
Unfortunately, the MIB is not bound by timescales, however, as a rule of thumb, they tend to work on matters a minimum of every 28 days.

How much compensation can I claim?

The amount of compensation you can claim differs depending on many factors, including the extent of your injuries and the damage to your property. Therefore, it is very difficult to answer how much you will receive until our solicitors have gone through the details of your accident and injury. Who is my cycling accident claim against?

Your claim will be against whoever is responsible for causing your injury. This could be a motorist, another cyclist, or the local authority if it’s due to a pothole or poor road surface.
