Cycling Accident Claims

Cycling Accident Claims

If you are a cyclist who has been injured in a road traffic accident that wasn’t your fault, you could be entitled to claim compensation. Even if no-one else was involved and you have been injured by a dangerous pothole or road defect, you can claim compensation. Cyclists are vulnerable road users, and when someone is involved in a cycling accident it can cause serious, catastrophic injuries. HNK Solicitors have years of experience in handling cycling accident claims and can help you claim the compensation you deserve.

According to the Department of Transport, there were a reported 160,597 causalities due to road traffic accidents in 2018, 25,511 of these were serious injuries and there were 1,784 road deaths in the same year. These statistics state that 17,550 of reported casualties were cyclists. Over half of road deaths occur in vulnerable road users, this includes pedestrians, pedal cyclists, and motorcyclists.

A cycling accident can have a huge impact on your life. It can cause not just pain and suffering from physical injury but also long-term psychological suffering. Cyclists involved in an accident may never fully recover and may even suffer long-term medical problems.

HNK Solicitors ensure you get the best quality rehabilitation and treatment and work tirelessly to offer round the clock care and support to help you adapt and look to the future. We put client care at the forefront of our cases and fight to get the compensation you deserve to make sure you are not left out of pocket.

We understand that bikes can be worth a substantial amount of money, some are worth even more than the car that hit you. When a bicycle is hit by a car the damage to the bike is considerably more extensive than the damage to the car. Many cyclists spend thousands of pounds on their bicycles, equipment, and clothing, which they are entitled to claim for. However, many insurance companies don’t understand the true value of this, so only offer a fraction of what you should be receiving.

Insurers may want to limit the amount of money they pay-out after an accident, but we make it our job to ensure you receive the maximum possible compensation.

What can I claim compensation for after a Cycling Accident?

After a cycling accident, you could be entitled to claim compensation for numerous things, including:

  • Physical injuries suffered – from bruising to broken bones
  • Psychological injuries suffered
  • Bicycle damage
  • Property damage – such as clothing, a helmet or any other attachments on your bike
  • Loss of earnings from having to take time off work due to injury
  • Medical costs for treatment and rehabilitation
  • Costs of making adaptations to your home or vehicle if required
  • The cost of having to hire carers or if your family have to take time off work to care for you
  • Travel costs after the accident if your bicycle was your main form of transport and you’ve had to pay for other transportation

Making a cycling accident claim

You have three years from the date of your accident, or the date you discovered your injuries were a result of your accident, to make a cycling accident claim. For those under the age of 18, you have three years from the date of your 18th birthday to make a claim. If you are claiming on behalf of a loved one who has sadly passed away as a result of the accident, you have three years from the date of their passing to make a claim. We recommend you make a claim sooner rather than later.

FAQ

When can I claim for cycling accident compensation?

There are many causes of cycling accidents. The most common causes in cases we deal with include:
• Road traffic collisions
• Potholes and poor road surfaces
• Defective equipment
• Car door collisions
• Animals
If you have been injured in a cycling accident that wasn’t your fault, you are entitled to claim for compensation. Even if you are partly responsible for your accident or injury you may still be able to claim as in most cycling accident claims it is unusual for a motorist to not be at least partly to blame when they collide with cyclists. For example, if you were hit by a reckless driver whilst not wearing a helmet you are entitled to claim compensation as the driver is responsible. However, you may receive less compensation because you were not wearing a helmet.
You can also claim if you were injured in an accident caused by a pothole or a poor road surface. If this is the case you can make a claim against your local authority.
Even if you have been injured in a hit and run accident or by an uninsured driver, you can still make a claim. If we cannot find out who caused your accident, HNK Solicitors can help you claim through the Motor Insurer’s Bureau (MIB).

Who are the Motor Insurers Bureau and what do they do?

The Motor Insurers Bureau (“MIB”) is a private governed body set up to compensate victims involved in road traffic collisions with an uninsured and/or untraced driver.
The MIB shall conduct a variety of investigations to ensure that they are satisfied that an incident has occurred as described before making a decision as to whether they shall compensate the victim. This can include a witness statement from the victims involved, obtaining the Police report, liaising with the victim’s insurance company and obtaining medical records/evidence.
Unfortunately, the MIB is not bound by timescales, however, as a rule of thumb, they tend to work on matters a minimum of every 28 days.

How much compensation can I claim?

The amount of compensation you can claim differs depending on many factors, including the extent of your injuries and the damage to your property. Therefore, it is very difficult to answer how much you will receive until our solicitors have gone through the details of your accident and injury. HNK Solicitors pride ourselves on securing you the maximum possible compensation for your cycling accident and have recovered thousands of pounds over the years for clients who have been involved in cycling accidents.
We can represent you on our ‘no-win no-fee’ agreement meaning you will not have to pay anything in the event your case is unsuccessful.

You will only pay us if you win and we deduct 35% of your compensation and recover your remaining legal fees from the Defendant.

If you have been affected by the Virgin Media data breach and have received a notification email, complete the ‘Claim Now’ or ‘Get in touch’ boxes on this page.

Who is my cycling accident claim against?

Your claim will be against whoever is responsible for causing your injury. This could be a motorist, another cyclist, or the local authority if it’s due to a pothole or poor road surface. If your accident was caused by a fault with your bike or safety equipment, the claim could be against the manufacturer. Although your claim is against whoever is responsible for causing your accident, the compensation you receive will be paid by their insurance company.
