FAQ
The timeframe for making a sexual abuse claim is usually 3 years from the date of the abuse, or 3 years from the date you turn 18. Given the difficulties victims suffer in coming forward with allegations of sexual abuse, the Court is often understanding of cases being brought out of time and there can be some exceptions to this rule due to the high sensitivity of this kind of offence.

Each case is specific to its own facts however depending on the abuser in question, it is still possible to pursue compensation from their estate or their employer if you were abused by someone in a working capacity e.g. a care home worker, teacher, a member or employee of a church, government worker etc.
If the abuser did not have any means to pursue compensation and did not abuse his position in an employment capacity then we would advise you to claim compensation under the CICA scheme, which we can do on your behalf.
Some claims can be settled in a few months, but more complex cases may take longer. Timescales vary from case to case, dependent on the amount of evidence needed and the severity of your injuries. We find that more complex cases take around 12 – 18 months to conclude.

In relation to applications to the CICA, there is no specific timescale that the CICA works too but they try to aim to make a decision on applications within 1 year. It can take longer in more complex cases where high-value settlements are required. We find that for more complex cases it usually takes on average 24 months for a case to conclude.
Children are entitled to pursue compensation however an adult has to make a claim on their behalf. The adult will act as what is known as a litigation friend.
